Idara ya Mipango na Sera

Objective

To provide expertise and services in planning, budgeting, implementation, monitoring and evaluation.

Functions

The Division have the following functions:-

  1. To coordinate preparations and Implementations of office plans and budgets;
  2. To encourage and facilitate the provision of services by the Private Sector;
  3. To prepare office contributions to the budget speech and annual economic report;
  4. To institutionalize strategic planning and budget skills;
  5. To coordinate and monitor implementation of government policies;
  6. To analyze policies from other sector and advise accordingly;
  7. To carry out monitoring and evaluation of the office plans and budgets and prepare performance reports;
  8. To carry out research, assessments and evaluation of office plans and provide a basis for making informed decisions on the future direction;
  9. To ensure that office plans and budgets are integrated into the government budgeting process; and
  10. To coordinate preparation and implementation of development projects/progammes and resource mobilization. This Division is led by a Director and comprises of two Sections as follows:-
  • Planning Section; and
  • Monitoring and Evaluation Section.

Planning Section

The Section performs the following activities:-

  1. Coordinate formulation and preparation of the office’s annual plan and medium term strategic plan;
  2. Compile office projects, programmes, Action Plans and develop strategies for resource mobilization;
  3. Liaising with parent Ministry of Finance and Economic Affairs and PO-PSM on Strategic Planning and budgeting process;
  4. Provide technical guidance and support for institutionalization of strategic planning and budgeting process;
  5. Participate in analysis of outsourcing of non-core functions(Private Sector Participation); and
  6. Prepare memorandum of understanding for projects and programs for international financing.
  7. The Section is led by an Assistant Director
  8. Monitoring & Evaluation Section
  9. The Section performs the following activities:-
  10. Monitor implementation of the office’s Annual Plan and Medium Term Strategic Plan;
  11. Prepare periodic (weekly, monthly, quarterly, mid-year, and annual) performance reports;
  12. Collect, study and analyze statistics needed in the formulation and implementation of policies, plans and budgetary proposals;
  13. Provide inputs in preparations of plans, programmes and budgetary activities of the office including establishment of performance targets and indicators;
  14. Provide technical support including institutionalization of M & E process;
  15. Undertake research and impact studies of plans, projects and programmes;
  16. Undertake service delivery surveys to collect stakeholders/clients views on services rendered;
  17. Coordinate mid-year and annual performance review; and
  18. Monitor performance of Executive Agencies

Objectives

To provide expertise and services on legislative drafting, translation of statutes and revision of statutes.

Functions

The functions of the Division are:

  1. To draft legislation(s) both principal and subsidiary
  2. To translate legislation(s)
  3. To revise legislation(s)
  4. The Division is led by a Chief Parliamentary Draftsman and comprise of three Sections as follows:
  5. Legislative Drafting Section.
  6. Law Translation Section.
  7. Law Revision Section.
  8. Legislative Drafting Section
  9. The Section performs the following activities:-
  10. Study proposals and consult Ministries, Independent Departments, Executive Agencies, public and other government institutions which requires to undertake legislative measures.
  11. Coordinate research on relevant legislation's and propose consequential amendments.
  12. Draft legislative proposals onto Bills.
  13. Draft subsidiary legislation and its amendments.
  14. Advise the Chairman of the Legislative Committee of the Cabinet, members of the standing committees of the National in respect of legislative drafting issues.
  15. Support the Minister and Attorney General in the presentations of new laws and amendments in the Cabinet and Parliament.
  16. Draft and vet legal documents such as affidavits.
  17. Prepare all legislation's and subsidiary legislation's to be submitted to the Government Printer for publication.
  18. Oversee printing and distribution of legislative instruments.

The Sections is led by an Assistant Director.

Law Translation Section

The Section performs the following activities:-

  1. Translate Principal legislation(s) and subsidiary legislation(s)The Sections led by an Assistant Director.Law Revision Section The Section performs the following activities:Revise laws and assign Chapters to enactments of Parliament;Prepare revised edition of the laws of Tanzania at given intervals of time;Incorporate and consolidate all principal legislation(s) and subsidiary legislation(s); and Codifying and indexing legislation(s)

Objective

To provide expertise and services on treaties and contracts on behalf of the Government

Functions

The Division performs the following functions:

  1. Prepare and advise on Treaties, Contracts, Memorandum of Understanding and other business memorandum involving the Government.
  2. Provide legal advice to the Government in relation to Regional, bilateral and multilateral treaties.
  3. Provide legal advice to the Government in negotiation of major contracts involving the Government or other contracts to which the Government has an interest.

This Division is led a Director and comprise of two sections as follows:

Treaties Section

The section performs the following activities:

  1. Review and provide legal advice on regional, bilateral and multilateral treaties involving the Government or to which the Government has an interest.
  2. Provide legal advice to the Government in Treaties, negotiation and other Treaty matters.
  3. Provide legal advice to the Government on the activities of UN agencies, AU, SADC, EAC, commissions and other international organizations that require submission of a country position.
  4. Conduct research on international treaty matters.
  5. Provide legal consultation to MDAs, LGAs and the general public on treaty matters.
  6. Advice Ministries on treaties that require ratification by the National Assembly.
  7. Advice Ministries and independent departments on implementation of Treaties.

The Section is led by an Assistant Director.

Contracts Section

The section performs the following activities:

  1. Provide legal advice in the preparation of Contracts, Memorandum of Understanding and other business memorandum involving the Government.
  2. Provide legal advice in negotiation of all major Contracts and other legal documents to which the Government is a party or to which it has interest.
  3. Provide legal consultation to MDAs and LGAs on contracts to which the Government has interest;Conduct research on Government contract matters.
  4. Advice MDAs and LGAs on Contracts that require ratification by the National Assembly.Advise MDAs and LGAs on implementation of contracts to which Government is a party or to which the Government has interest.
  5. Vet and advise on procurement Agreements/Contracts.Prepare legal Opinion where they are a condition precedent for effectiveness of Loan Agreements from Multilateral Financial Institutions.Advise Consolidated Holding Corporation (CHC) on privatization of companies under it.Advise on all Government contracts before they are signed.

Objective

.To provide expertise and services on human resources management and administrative matters to the Office

Functions

.The Division performs the following functions:-

  • To advice the Deputy Attorney General n administrative and human resources matters
  • Provide strategic inputs to management on administration and human resources management issues such as recruitment, human resources development and training, promotion, retention, motivation, performance management and welfare.
  • Process terminal benefits and leave.
  • Ensure optimal efficient and effective Management and utilization of Human Resources in the Office.
  • Link between the Office of Attorney General and the Public Service Management Office on operationalisation of the Public Service Management and Employment Policy and laws governing Public Service.
  • Provide data support and up-date records on various Human Resources information.
  • Collect, analyze, store and disseminate data and information related to human resource development plans.

The Division is led by a Director and comprises of two sections as follows:

  • Administration Section.
  • Human Resource Management Section.

.Administration Section

.The Section performs the following activities:-

  • Interpret and enforce principal legislation governing the Public Service including regulations; standing orders and other labor laws.
  • Facilitate employees relations and welfare including health, safety, sports and culture;
  • Provide registry, office records, messengerial and courier services.
  • Handle protocol matters.
  • Facilitate provision of security services, transport and general utilities.
  • Facilitate general custodian services including maintenance of office equipments, buildings and grounds.
  • Coordinate implementation of ethics and value promotion activities including prevention of corruption practices.
  • Implement diversity issues including gender, disability, HIV/AIDS etc and be the Office’s Gender Focal Point.
  • Administer the implementation of Business Process Improvement.
  • Advise on organizational efficiency of the Office.
  • Administer the implementation of Client Service Charter.
  • Administer implementation of Private Sector Participation.
  • Coordinate the preparation and implementation of the Wage Bill and Recruitment.

Human Resource Management Section

.The Section performs the following activities:-

  • Coordinate staff recruitment, selections, placements, confirmations and transfers.
  • Facilitate Human resource training and career development (professional development, skills enhancement performance improvement, pre-retirement, part-time, and overseas).
  • Facilitate orientation/induction program for the new entrants;
  • Carry out human resources planning to determine supply and demand needs for professional.
  • Administer Salaries and process payrolls.
  • Process and update records of various leaves such as annual, sick, maternity, study and terminal.
  • Oversee employees benefits (pension, allowances etc) and entitlements.
  • Serve as a Secretariat to the employment Committee.
  • Coordinate implementation of Open Performance Review and Appraisal System (OPRAS), assess the appraisal results, prepare implementation reports, and make follow-ups on the implementation of the recommendations on individual OPRAS forms.
  • Prepare Annual Personnel Emolument Estimates.
  • Prepare and facilitate implementation of succession plans.
  • Carry out training needs assessment for the office and prepare training programs.
  • Monitor and evaluate implementation of institutional training programs and prepare training reports.
  • Carry out impact assessment of the training programs and prepare assessment reports; and
  • Initiate and co-ordinate in –house courses and on the job training.
